Als das wären, bei der Verfolgung von Straftaten und Ordnungswidrigkeiten dieselben Rechte und Pflichten wie Behörden und Beamte des Polizeivollzugsdienstes nach den Vorschriften der Strafprozessordnung und des Gesetzes über Ordnungswidrigkeiten zu haben und zu realisieren.

J. Kraus: Welche eigentlich eine Anfrage an den Ausschuss für Arbeit und Sozialordnung des DB war!

Begründung (auszugsweise wiedergegeben)

Der Petent beanstandet, dass im Bereich der Arbeitsverwaltung Angestellte, die sich in einem befristeten Arbeitsverhältnis befanden, mit der Wahrnehmung hoheitlicher Aufgaben betraut worden seien.

Die Arbeitsverwaltung hatte Prüfgruppen zur verstärkten Bekämpfung der illegalen Beschäftigung eingerichtet. Da die anfallenden Aufgaben nicht von dem vorhandenen Personal wahrgenommen werden konnten, wurden zusätzliche Angestellte mit Zeitarbeitsverträgen eingestellt.

Der Petent war als Aushilfsangestellter im Bereich des Außendienstes der Leistungsabteilung eines Arbeitsamtes
in den neuen Bundesländern als Bürosachbearbeiter tätig. Dabei oblag ihm im Zusammenhang mit der Bekämpfung illegaler Beschäftigung die Prüfung von Firmen.

Der Petent wirft dem Arbeitsamt vor, dass sich wegen seiner Tätigkeit als Prüfkraft die Suche nach einem neuen Arbeitsplatz problematisch gestalten könne.

Insbesondere deswegen, weil mit den Ausführungen im Zeugnis für künftige Bewerbungen “beauftragt mit Einzel- und Gruppenermittlungen” auf Betriebsprüfungen und die Ermittlungen gegen Arbeitgeber hingewiesen wird.

In seinen Einwendungen grenzt der Petent sein Vorbringen dahingehend ein, als es ihm um die Klärung der Frage gehe, ob er im Interesse und Auftrag des Staates liegende, der Staatsanwaltschaft in ihren Rechten und Pflichten gleichgestellte Ermittlungen in befristeten privatrechtlichen Arbeitsverhältnissen ausführen durfte.

der Deutsche Bundestag als das oberste demokratische Staatsorgan meint:
Unter Einbeziehung der hierzu eingeholten Stellungnahme des BMWA und des Bundesministeriums der Justiz, läßt sich das Ergebnis der parlamentarischen Prüfung wie folgt zusammenfassen:

Gemäß Artikel 33 Abs. 4 des Grundgesetzes ist die Ausübung hoheitsrechtlicher Befugnisse als ständige Aufgabe in der Regel Angehörigen des Öffentlichen Dienstes zu übertragen, die in einem öffentlich-rechtlichen Dienst- und Treueverhältnis stehen.

Die Vorschrift ist wegen der doppelten Einschränkung, wonach die Übertragung nur “als ständige Aufgabe” “in der Regel” erfolgen müsse, sehr elastisch.

Ist diese Einschränkung des Grundrechtes für mich unverhältnismäßig, weil die Auswirkungen dieser Einschränkung meine persönliche Ehre schädigen und mir z.B. aufgrund o.g. abschlägiger Bewerbungsbescheide seit Jahren das Recht auf Entfaltung der Persönlichkeit dauerhaft verwehren?

Die BA und die Behörden der Zollverwaltung sowie ihre Beamten haben bei der Verfolgung von Straftaten und Ordnungswidrigkeiten, die in unmittelbaren Zusammenhang mit einem der in § 304 Abs. 1 Drittes Buch Sozialgesetzbuch (SGB III) genannten Prüfgegenstände stehen, dieselben Rechte und Pflichten wie Behörden und Beamte des Polizeivollzugsdienstes nach den Vorschriften der Strafprozessordnung und des Gesetzes über Ordnungswidrigkeiten; die Beamten der Zollverwaltung sind insoweit Hilfsbeamte der Staatsanwaltschaft (§ 306 Abs. 3 SGB III). Damit handelt es sich bei den hier wahrgenommenen Aufgaben zweifelsfrei um hoheitsrechtliche Tätigkeiten.

Die Übertragung von Prüfungen nach § 306 Abs. 3 SGB III als hoheitliche Aufgabe auf Zeitangestellte der BA kann deshalb aus Sicht des Petitionsausschusses nicht beanstandet werden. Aus der Tatsache, dass der Petent in befristeten Arbeitsverhältnissen hoheitliche Befugnisse wahrgenommen hat, kann er auch keinen Rechtsanspruch ableiten. Die Vorschrift ist nicht dazu bestimmt, insoweit subjektive Rechte zu schützen.

Einen Rechtsanspruch haben wollen, bloß weil man mit Daueraufgaben aus dem Kernbereich hoheitlicher Befugnisse des Staates b e f r i s t e t betraut und bestimmt war angewiesene Pflichten bezüglich von Eingriffsrechten und erkennungsdienstlicher Behandlungen ausführen zu müssen! Und womöglich daraus noch subjektive Rechte ableiten und schützen zu wollen. Eine Unverschämtheit. Das gibt es ja nur bei Festangestellten! Eine Strapaze für die FDGO? Was mir bleibt, ist mich bei den vielen Arbeitgebern zu entschuldigen, gegen die ich einst ordnungs- und strafrechtlich ermittelte und bei denen ich mich nun auch um Arbeit bewerben muss und möchte.

Der Petitionsausschuss empfiehlt, das Petitionsverfahren insgesamt abzuschließen, weil er hinsichtlich der Übertagung von hoheitlichen Aufgaben auf Angestellte mit Zeitarbeitsverträgen Anhaltspunkte für ein fehlerhaftes Verwalten des Arbeitsamtes nicht feststellen konnte.

Dies sah am 30.Juni 1999 der SPD Staatsminister beim Bundeskanzleramt Namens Rolf Schwanitz mit den Worten “In der Sache selbst ist mir die Reaktion des Arbeitsamtes Plauen genauso unverständlich wie Anfang des Jahres 1998. Ich habe deshalb in Ihrer Angelegenheit einen erneuten Vorstoß gegenüber dem Landesarbeitsamt Sachsen vorgenommen” gar nicht so.

Und nach mehrmaliger Nachfrage bezüglich des Ergebnisses des erneuten Vorstoßes kommt gleicher Herr der SPD am 19.09.02 zu der Einsicht “Leider komme ich auch zu keinem anderen Bewertungsergebnis”. Sozusagen inhaltlich dem Obigen.
